What is Baggage liability?

Baggage liability is an airline's obligation for delayed, damaged or lost luggage, capped at a maximum amount per passenger.

Baggage liability is an airline’s obligation for delayed, damaged or lost luggage, capped at a maximum amount per passenger.

Also called: Airline liability for baggage.

How it works#

What is paid is proven loss up to the cap, not the replacement value of a suitcase full of keepsakes. Valuables, electronics, medication and documents are routinely excluded in the conditions of carriage and belong in hand luggage. Deadlines decide everything: damage reported too late is lost no matter how large it was.

Not to be confused with#

Baggage liability is not the same as baggage insurance: liability falls on the airline by law, insurance rests on a separate contract you bought.

In German#

The German term is Gepäckhaftung. German version of this term

  • Property irregularity report: A property irregularity report is the record filed at the airport for missing or damaged baggage and the basis of every later claim.
  • Montreal Convention: The Montreal Convention is an international treaty governing airline liability for baggage, delay and personal injury on international journeys.
  • Through-checked baggage: Through-checked baggage is luggage tagged to the final destination at the first departure, so it does not need collecting at the connecting airport.
